Muniment of Title

What is Muniment of Title?

Muniment of Title is a legal term that indicates ownership of an asset. A Muniment of Title proceeding is one in which a probate court admits a will to probate solely for the purposes of establishing title to personal and/or real property.

What are the requirements to probate a will as a Muniment of Title?

The Court must find that:

  1. A will exists;
  2. The estate does not owe an unpaid debt other than a mortgage payment or other debts that are secured by liens on real property; and
  3. No necessity for an administration of the estate.

What statute governs the probating of a will as a Muniment of Title?

Chapter 257 of the Texas Estates Code.
