Who are the heirs to an estate when someone dies intestate (without a will)?

First, determinations are needed as to whether the decedent’s property was separate property or community property, whether the decent was married or unmarried, whether the decedent had children or not, and whether the decedent’s children (if any) were also the children of decedent’s spouse.

Second, once these determinations are made, the heirs to an estate can be determined by looking to Chapter 201 of the Texas Estates Code.
